The City Clerk read by title, an ordinance of the City of Maitland, Orange County, Florida, establishing a temporary 180 day moratorium within the City of Maitland prohibiting the establishment and operation of medical marijuana treatment center dispensaries during the 180 moratorium period; providing for findings; providing for severability; providing for conflicts; and providing an effective date.

Mr. Mark Reggentin, Assistant City Manager, stated, as discussed at the July 10, 2017 City Council meeting, the Governor signed a bill adopting regulations for the production, sale and dispensing of medical marijuana. Based on the parameters from a local government regulatory standpoint, and the fact that the legislative session is beginning early. Council determined the most prudent approach would be to enact a moratorium in an effort to determine how to best approach any new local regulation while monitoring the situation in the Capital. He stated, to accomplish this, the City Attorney drafted an ordinance to establish a 180 day moratorium prohibiting the establishment and operation of medical marijuana treatment center dispensaries. Additionally, as the moratorium deals with land use, following the introduction of the ordinance, it will be forwarded to the Planning and Zoning Commission for review and comment prior to holding the adoption hearing.

Mayor McDonald requested public comments. There being no one who wished to be heard, Mayor McDonald closed the public comment period.

A motion was made to introduce on first reading an ordinance establishing a temporary moratorium within the City of Maitland prohibiting the establishment and operation of medical marijuana treatment center dispensaries during the 180 day moratorium period; and, set the Public Hearing date for August 28, 2017.

Mr. Mark Reggentin, Assistant City Manager, stated the ordinance was introduced at the July 24, 2017 City Council meeting and subsequently received unanimous approval from the Planning and Zoning Commission on August 3, 2017. Tonight’s meeting is the final reading and adoption of the ordinance. Mr. Cliff Shepard, City Attorney, answered questions posed by Council.

Mayor McDonald opened the Public Hearing. Reverend John Butler Book, 230 West Ventris Avenue, spoke in favor of the ordinance and of a total ban against the dispensaries. There being no one else who wished to be heard, Mayor McDonald closed the Public Hearing.

A motion was made to adopt Ordinance #1320 establishing a temporary moratorium, within the City of Maitland, prohibiting the establishment and operation of medical marijuana treatment center dispensaries during the 180 day moratorium period.
