The City Clerk read by title, an ordinance of the City of Maitland, Florida amending the Code of Ordinances, Chapter 7.5 "Land Development Regulations" Article VII. "Planned Development, Article X. "Site Plan and Permitted Conditional Uses Review Process", Article XI "Subdivision Process" and Article XIV "Zoning Amendments" to remove review timelines between Planning and Zoning Commission Public Hearing and the Planning and Zoning Commission Recommendation Meeting; and to amend zoning amendment notification process for city-initiated zoning amendments and modifying the process to request zoning text amendments. Providing for Conflicts; providing for severability; providing an effective date.

Mr. Dan Matthys, Community Development Director, stated the proposed ordinance is a modification to Chapter 7.5 of the Maitland City Code and reviewed the recommended changes to the ordinance. On August 17, 2017, the Development Review Committee (DRC) met and the Planning and Zoning Commission held a public hearing. DRC recommended approval of the ordinance and the Planning and Zoning Commission (P&Z) voted to forward the proposed ordinance to City Council with a recommendation of approval. Mr. Matthys, the City Attorney, and the City Manager answered questions and addressed concerns posed by Council.

Councilman Lowndes recommended language additions and changes to assure the applicant goes before the DRC, for its recommendation, prior to going before the Planning and Zoning Commission and City Council; and, language that puts the onus on the applicant to make their petition readable. Those recommended changes are as follows: Line 62 -after - made at the hearing - and shall work with the applicant to ensure that the proposal is consistent with the provide reasonable assistance to the applicant toward reaching compliance with the Land Development Codeā€¦. Line 71 - after - Development Review Committee ;however, in no case will a petition be reviewed by Planning and Zoning Commission or City Council without a recommendation from the Development Review Committee. Additionally, he recommended putting a time limit on DRC to come together to provide such. The City Manager stated to include language changes that disallow the applicant to demand the next P&Z or City Council meeting but allow for those meetings when the DRC report is available.

Mayor McDonald requested public comments. There being no one who wished to be heard, Mayor McDonald closed the public comment period.

A motion was made to introduce an ordinance on first reading to modify Chapter 7.5 of the Maitland City Code to reflect development review process changes to include the suggested change by Councilman Lowndes; and, set the Public Hearing date for September 11, 2017.
